Biden Promises to Pass Equality Act

( – Democratic presidential nominee Joe Biden promises to threaten several Constitutional guarantees if he is elected president on Tuesday. In the first 100 days of a Biden administration, the former vice president said he would pass the Equality Act passed by the House in 2019. If turned into law, the Equality Act would revise the Civil Rights Act of 1964 to include sexual orientation and gender identity, setting up a clash with the US Constitution.

The Civil Rights Act of 1964 prohibits discrimination based on race, religion, sex, and national origin. However, by making sexual orientation and gender identity a protected class, many legal scholars question what that could mean for religious liberties.

Last year, the Trump administration opposed the bill, saying it’s “filled with poison pills that threaten to undermine parental and conscience rights.”

The Legal Challenge

In 1964, the Civil Rights Act was passed to prohibit segregation and discrimination of African Americans in public schools, places, activities, and in employment matters. However, if Biden gets his way, it would go well beyond the original legislation’s rightful intentions by penalizing religious Americans for their beliefs about marriage and biological gender.

But, it also has the effect of burdening businesses, medical care systems, families, and women.


The Equality Act could have a chilling impact on businesses and employers. This is already being tried at the state level.

A baker in Colorado took his case all the way to the Supreme Court after the Colorado Civil Rights Commission found him guilty of discrimination based on sexual orientation. The baker is a Christian who refused to bake a cake for a gay couple. They sued, and ultimately the baker won in the Supreme Court based on his religious convictions.

The Equality Act would have the chilling effect of creating conflicts between employers and customers and could ruin livelihoods over religious beliefs.

Medical Care

The bill would force Catholic hospitals to provide gender transition services, even if it goes against their religious beliefs. It has already happened in California, New Jersey, and Washington. The bill would politicize medicine and force doctors and nurses to offer procedures not based on science, but on ideology or political correctness.


The Equality Act could put parental rights at risk and strip the abilities of parents to make decisions for their children’s medical treatment. In the American Journal of Bioethics, an article states that the government should overrule the parents of gender dysphoric children who don’t want their kids to get puberty-blocking drugs if they aren’t medically necessary. Additionally, schools may begin teaching about gender issues that parents don’t want their kids to hear at a young age.


Sexual orientation and gender identity laws could force women out of female-only sports facilities and gender-specific facilities and spaces. That could include bathrooms and locker rooms. In addition, it could hurt women in sports.

In 2019, two high school biological men were allowed to compete as women in track because of their preferred gender identity. They easily won first and second place against female competitors, taking away potential scholarships and other awards from biologically female athletes.

Biden supports a bill that threatens to empower the government’s ability to force how Americans think, feel, speak, and act. It could forever change the way people interact with one another at home, school, work, and play. It infringes on the freedom of religion and assembly guaranteed in the US Constitution.

It’s just one more thing to consider when heading to the polls on Tuesday.
